There has been another delay in Tory Lanez’ sentencing.
On Monday (April 17), Los Angeles County Superior Court Judge David Herriford said he will consider Lanez’ motion for a new trial on May 8th after Lanez lawyers requested extra time to add to their 84-page filing.
Lanez’s lawyer Matthew Barhoma said he and his co-counsel Jose Baez, agreed with prosecutors to file the supplement on May 1, and prosecutors will have until the close of business on May 3 to respond.
Deputy District Attorney Kathy Ta told Herriford she and co-counsel Alex Bott object to any delays past May 8 because Megan Thee Stallion has a right as a victim to see Lanez sentenced in a timely manner. She also said Megan could give a victim impact statement.
Lanez appeared in court wearing orange prison attire, white sneakers and a black knit cap on his head. Lanez said yes when asked if he agreed with the new date. As the bailiff escorted him out, he smiled and waved at his family. His father, Sonstar Peterson was present, as were his brother, and his son’s mother.
Lanez was convicted on December 23, 2022, for shooting and injuring fellow hip-hop star Megan Thee Stallion. A jury convicted him of assault with a firearm, negligent discharge of a firearm and possession of an unregistered firearm. Since he acquired new attorneys, his sentencing has been pushed back several times.
Lanez’ new legal team – led by Baez – has represented Casey Anthony, Aaaron Hernandez and Harvey Weinstein.
They filed a motion for a new trial on March 29th, arguing in part that certain evidence presented at trial and some statements made by witnesses on the stand were prejudicial to their client, including an Instagram post and a photo of Lanez’s gun tattoo. The motion, which was obtained by HipHollywood, also takes issue with the forensic testing and claims that Lanez’s right to counsel of his choice was violated.
If Lanez’ appeal motion is denied on May 8th he will be sentenced within 30 days. The rapper is facing 22 years in prison for the charges and could be deported back to Canada.
